1. Acceptance of Terms
By accessing or using Doncaster Moto Parc's facilities, services, or website, you agree to be bound by these Terms of Use. If you do not agree, please do not use our services.
These Terms are in addition to your statutory rights under UK law, including the Consumer Rights Act 2015, which remain unaffected.
2. Age and Participation Requirements
Minimum Age: Riders must be at least 8 years old for junior tracks and 16+ for adult tracks.
Minors: Riders under 18 require written parental or guardian consent and must be accompanied and supervised at all times by a responsible adult.
Parental Waiver: Parents or legal guardians must sign liability waivers and indemnification agreements on behalf of minors before participation.
Track-Only Use: The facility is for off-road riding only. No road licence is required, but riders must demonstrate basic competency before accessing the track.
3. Assumption of Risk
Motocross and motorcycle riding are inherently dangerous and carry significant risks of serious injury or death. By participating, you acknowledge and accept these risks, including but not limited to:
- Collisions with other riders, obstacles, or equipment
- Falls, crashes, or mechanical failures
- Weather-related hazards and changing track conditions
- Rider error or inadequate safety equipment
You voluntarily participate with full knowledge of the dangers involved.
4. Liability and Release
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability which cannot legally be excluded under UK law
Subject to the above, you release and waive Doncaster Moto Parc, its owners, staff, and affiliates from liability for claims arising from your participation, to the extent permitted by law.
5. Indemnification
You agree to indemnify and hold harmless Doncaster Moto Parc from claims, damages, or expenses (including legal fees) arising from:
- Your use of our facilities or services
- Your breach of these Terms
- Your infringement of another party's rights
- Claims brought by third parties as a result of your actions
6. Safety Requirements and Equipment
Mandatory Equipment:
- CE or ECE-approved motorcycle helmet
- Long trousers and long-sleeved shirt or riding gear
- Sturdy closed-toe boots (motorcycle boots recommended)
- Protective gloves
- Eye protection (goggles or visor)
Recommended Equipment: Body armour/chest protector for all riders
Safety Briefing: First-time riders must attend a mandatory briefing. Returning riders confirm they have reviewed track rules and conditions.
Medical Consent: By participating, you consent to emergency medical treatment if you are unable to make decisions yourself.
7. Track Rules and Conduct
All riders must:
- Follow posted rules and staff instructions
- Ride only in designated areas during operating hours
- Respect other riders and maintain safe distances
- Report any accidents or hazards immediately
- Not ride under the influence of drugs or alcohol
- Submit to sobriety testing if requested
Zero Tolerance: Violations may result in immediate removal without refund and possible suspension from the facility.
8. Insurance and Financial Responsibility
No Insurance Provided: Doncaster Moto Parc does not provide personal injury or property insurance. Participation is at your own risk.
Personal Insurance: You are strongly advised to maintain insurance that covers motocross activities (medical, disability, and property).
Equipment Damage: You are fully responsible for damage to rented equipment and may be charged for repair or replacement.
Third-Party Damage: You are liable for damage caused to others' equipment or property.
9. Rentals and Memberships
Rental Equipment: Must be returned in the same condition as provided. Additional charges apply for loss, theft, or damage.
Membership Plans: Terms, pricing, and benefits may change with 30 days' notice.
Cancellations: Cancellations made 48+ hours in advance qualify for a full refund. Cancellations made 24-48 hours in advance receive account credit. Weather-related closures will be refunded or rescheduled. See our Cancellation Policy for full details.
Force Majeure: We are not responsible for closures due to weather, government orders, or events beyond our control.
10. Privacy, Photography, and Data Protection
Safety Use: CCTV and photography may be used for safety and security.
Marketing Use: We will request separate, explicit consent for marketing photography. For riders under 16, parental consent is required. Consent can be withdrawn at any time.
Data Protection: Personal information is collected and processed in line with UK data protection law and our Privacy Policy.
Electronic Signatures: You consent to the use of electronic signatures and records for agreements and waivers.
11. Limitation of Liability
To the maximum extent permitted by law, our total liability to you shall not exceed the amount you paid for the service giving rise to the claim. We are not liable for indirect, consequential, or punitive damages.
12. Governing Law and Dispute Resolution
These Terms are governed by English law. The courts of England and Wales have exclusive jurisdiction.
We encourage resolving disputes by good-faith discussion. You may also use recognised Alternative Dispute Resolution (ADR) services. This does not affect your right to bring proceedings in court. If you are an EU consumer, you may also use the EU Online Dispute Resolution platform.
13. Changes to These Terms
We may amend these Terms at any time. The latest version will always be posted on our website with the date shown at the top. Continued use of our services after changes means you accept the updated Terms.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain valid.
